Cannabis Cooperative Gives New Hope to the Industry

The creation of cannabis co-operatives by state lawmakers may never have a chance to get off of the ground. The state of Colorado recently approved a plan that is meant to help marijuana stores deal with the enormous cash sums they experience. In September 2011, the last bank in the state of Colorado closed its doors to working with medical marijuana businesses. This action forced businesses to operate in cash-only, which obviously leaves the owner in a very risky situation with no place to deposit their money.

According to an article on May 12th by the National Cannabis Industry Association, “State lawmakers late Wednesday night approved a law giving marijuana-store owners the right to create cannabis co-operatives, which would operate like banks or credit unions. Gov. John Hickenlooper previously indicated he would sign a slightly different bill but has repeatedly called on federal lawmakers to change laws on the national level.”

The bill is being co-sponsored by Democrat Sen. Pat Steadman and Republican Rep. Tom Massey. Senate Bill 75, if passed, would allow medical marijuana businesses to create cooperatives that would be regulated similar to credit unions while also being insured by “non-federally backed” insurance policies. Brian Vicente, of marijuana advocacy group Sensible Colorado, informed The Huffington Post that “Colorado’s tightly regulated medical marijuana businesses need banking that allows them to operate like other state licensed businesses.”

Under the proposed bill, cannabis co-ops would be able to provide banking services like issuing checks and electronically transferring funds. However, this can only happen if permission is given at the Federal level. “Most everyone agrees that banking needs to be fixed at the federal level. However, Congress appears to be unwilling to act, and Coloradans don’t have time to wait,” said Mike Elliott of the pot lobby’s Marijuana Industry Group in a statement to Coloradoan. “(This law) is likely not a solution to the banking problem but an opportunity to move the conversation forward.”

Marijuana store owners are in support of the Colorado co-op bill, saying they are tired of playing games with the banks. Having accounts closed by banks and having to open accounts using benign names is not only stressful, but it also leaves the owners at risk to crimes since the public is well aware of the industry being forced to operate in cash-only.

Elan Nelson, spokeswoman for Denver-based marijuana store Medicine Man, revealed her opinion to the Coloradoan. “While the cannabis co-op law likely won’t directly lead to changes, it’s a place to start”. The Concern with Marijuana Cultivators Water Use

Marijuana cultivators illegal and legal in Northern California are possibly draining all the water from a region that is shadowed in drought. The streams and rivers are already running dry and the cultivators are sucking what little water is left out of them.

California Department of Fish and Wildlife are finding streams that will probably dry up this year, and the agency feels it is more than likely the marijuana cultivators behind this serious problem.

“Essentially, marijuana will consume all the water that is left, every bit of it, “said State Fish and Wildlife Senior Environmental Scientist Scott Bauer, who specializes in salmon recovery who is currently working on a study of this problem. Hopefully these finding will be released soon, and we will know the real impact of this unregulated industry.

California has been on the radar for a while for polluting the streams and the forest with the use of pesticides and trash. California also has had a history of bulldozing trees and earth to make clearings for gardens.

A red flag goes up when the State Fish and Wildlife see a huge spike in water usage; this is usually an indication that there is a very big possibility that you will find a pot cultivation operation being run.

Over time this increase in water usage will add to the drought conditions, which in turn will add to the habitat degradation and kill off the restoration efforts that many have worked to replenish, and replace.

“The destruction of a habitat is actually quite staggering” said Patrick Foy, a spokesman with the State Department of Fish and Wildlife. “Last year, 24 North Coast salmon-bearing tributaries were reported to have gone dry, though not all were verified by the agency” said Bauer

Even if California was not having a problem with drought there still would not be enough water for the marijuana cultivators because the plants require a vast amount of water and the industry is growing rapidly.

Illegal marijuana was confiscated in California by law enforcement recently it totaled between $2-4 million dollars annually it was estimated that the cultivators used 1.8-billion gallons of water over a five-month growing season which was based on the average water usage documented in a study.

Satellite images, give researchers the information they need to determine that approximately 30,000 legal and illegal marijuana plants are growing all along the four major watersheds just in Mendocino County alone,  and there are probably tens of millions more in neighboring Humboldt and Lake counties.

Each plant consumes an average of six gallons of water a day, so the plants in question located in Mendocino County probably consume 180,000 gallons a day from each watershed, which is the size of a 160 foot Olympic-sized pool/spa.

New Yorkers Overwhelming Support Medical Marijuana and the Passage of the Compassionate Care Act

In a poll conducted by Quinnipiac University released on February 17th, it was revealed that 88-9 percent of New York voters support the legalization of medical marijuana.  In another poll, 57-39 percent of voters support the legalization of small amounts of marijuana for personal use.

It should come as no surprise that New York is overwhelmingly for the legalization of medical marijuana. Since 1997, the Compassionate Care Act has been floating around waiting to be seriously considered. According to the Compassionate Care NY website’s description of the Act, “The New York proposal was drafted with careful, strict controls: under tight regulation, a patient who has been certified by a healthcare provider to use medical marijuana would register with the New York State Department of Health and receive a patient identification card. Specially approved organizations — such as hospitals or community health centers — would dispense the medical marijuana to registered patients, under DOH supervision.”

Especially with the success the Marijuana industry has experienced in Colorado upon medical marijuana being legalized, New Yorkers are hoping that now is finally the time for the Compassionate Care Act to finally be passed. In an article on HuffPost by Christopher Mathias with State Sen. Diane Savino (D) (sponsor of the measure), Savino “told HuffPost that she “easily” has enough votes to pass the bill now, even if not every one of those senators has publicly announced his or her support.” A confident Savino also revealed that her confidence stems from knowing she has 40 votes to pass the bill, which is ideal considering that the bill only needs 32 yes votes in order for it to be passed.

In an effort to work around the waiting process, Gov. Andrew Cuomo (D) revealed a plan to help those who desperately need the help of medical marijuana as they combat serious, specific illnesses. The governor’s plan involves a limited medical marijuana program which does not require the normal legalization process. In the article on HuffPost by Mathias, he writes that “Under the governor’s plan, medical pot is available at 20 hospitals for people suffering from specific illnesses. Savino has called the plan “unworkable” and expressed serious doubts that the federal government would allow it.” Some patients suffering from illnesses that are in need of such treatment have even considered moving to Colorado now that medical marijuana has been legalized there.

While there is interest in using marijuana for personal use, as seen in the poll revealing a vote of 57-39 percent, it seems that the big push here is for the use of medical marijuana to be passed for the betterment of patients. Many people are upset that the Compassionate Care Act has been sitting on the back burner for so long. In an interview with HuffPost’s Mathias, State Sen. Mark Grisanti (R) stated, “It’s time to put politics aside, and put people first.” For now, New York State will simply have to wait for the legalization of medical marijuana to be passed.

55% Favor Marijuana Legalization in California

The majority of Californians now favor legalizing marijuana for the first time ever, according to a new Field Poll.

The survey, which includes responses from 1,002 registered Californian voters between Nov. 14 and Dec. 5, found that 55% now favor legalization.

Just 31% said they support strict enforcement of the current laws or the passing of tougher laws governing marijuana. Another 12% said they support the current ban on recreational cannabis but believe the government should ease penalties.

How William Hearst influenced the war on Marijuana

William Hearst waged a war on marijuana to take away the competition using any means necessary to stabilize his livelihood. Unfortunately for the American people he had political pull and he wasn’t afraid to benefit by using his strong influence. Back in the roaring twenties, as we came into the technological age, our beliefs and things we understood, were antiquated at best.

The black cat was still to be feared. Polio was a killer and so was the common cold. People still believed that bleeding a person was the only way to save them. And in among all this geriatric learning we did, one evil was traded for another.

Hearst’s influence

Hearst joined the wealthy DuPont family who held many exclusive patents on chemicals used in manufacturing paints, plastics and paper that could become worthless if hemp products became widely available.  Hearst was fearful of the affects those products would have on his paper mills and other businesses. So they formulated a plan to prevent the cultivation or importation of hemp products into the United States as many men do when they’re threatened.

With his friends of fancy and plans being laid, the Volstead Act was worked on until he had it abolished and replaced with the war on drugs. This circle of influence reached to the highest of our politicians. Whether or not they knew they were being used, is entirely up to history. Between 1930 and 1937, Hearst and the DuPont Empires, had convinced several states to outlaw marijuana possession and by 1937 “The Anslinger Act” – formally known as the “Marihuana Tax Act of 1937” – was passed by Congress. It imposed a prohibitive tax on the cultivation and importation of hemp and hemp products and criminalized marijuana use at both the state and federal levels.

Using his paper

He began the war with his newspaper and surreptitiously began attacking the DuPont’s and their empire. All the while, being very wily and fox like. His articles were scathing, and bringing forth the evils drug lords and pot smokers could do. He was terrifying the quiet house wife, and preaching to all those that would listen.

The newspapers of the time were known as the Muckraker’s for a reason and William Hearst and the influence he derived, was no exception. He had no problem with assisting in the continuation of fraud, fear and keeping the balance on his side of the sidewalk.

It was so devoutly done that in 1937 Marijuana was outlawed and alcohol became legal to have again. The Speak Easys died away and Hearst held onto his empire.

All that legal wrangling done over eighty years ago and we still have issues with the marijuana trade. It’s also a part of the high risk list for merchant accounts. Right along with airline tickets, musical tickets and simple things that we all rely on daily. Who would know, that William Hearst’s ramblings in his newspaper would still have a handhold on us almost a century later.

Although we know that people that use the marijuana respond differently to it. Some have no effects and others have grand ramifications. The point is, this little weed and other high risk merchant accounts have difficulties reaching a decision because of their fly by night methods. Because one man deemed this plant something of evil, and beyond reason, several other industries followed.
