Changes to the NFL’s Drug Policy are being considered

A revision to the NFL’s drug policy will come too late for Cleveland Browns wide receiver Josh Gordon. After multiple positive marijuana tests, he will likely be suspended for the season. While the use of marijuana is not wide-spread in the NFL, its use is present. According to Cindy Boren’s article for The Washington Post, some players use marijuana to ease the violence of the sport while others use it for the stress; such as, the media, the pressure of winning, and dealing with the coaches.

If the NFL’s drug policy is revised, finalized and announced it will contain changes specific to marijuana and other drugs that are abused. The changes will involve a decrease in the punishment involved when violations occur, along with an increase in the threshold for a positive marijuana test. At present, the recreational use of marijuana is legal in two NFL cities, Denver and Seattle.

The NFL Players Association plans to look into the medical research that has been used in the support of it being legalized in some states for medicinal use. In the meantime, the NFL still insists that the commissioner be the final say when discipline must take place; their insistence over arbitration of disciple is actually the cause of the pause in implementation and change to the league’s drug policy.

Another situation has arisen that may affect the NFL’s decision on marijuana use. Another lawsuit has been announced involving eight retired players who are suing the NFL on the grounds that their painkiller addition was the result of playing pro football.

According to an article by Michael McCann, legal analyst and writer for Sports Illustrated and SI.com, “The lawsuit portrays the NFL and its teams as taking extraordinarily unethical steps to suppress players’ pain so they could remain on the field. According to the complaint, team doctors and trainers routinely prescribed medications without prescriptions and without warning players about the risk of addiction and side effects.”

McCann then addressed the impact marijuana legalization will have on the NFL. He quotes one, prominent NFL agent as saying, “What is the alternative to marijuana? The alternative sucks. Think about what players take for pain—they take much more serious and much more addictive drugs. Vicodin. Percocet. Oxycodone. These are highly addictive and synthetically manufactured drugs. … They can rip up your insides. I would much rather my guys take natural, less addictive stuff.”

Medical Marijuana is Projected to be Nevada’s Next, Big Crop

According to an article by MMJ Business Daily, “Alfalfa earns $100 profit per acre-foot of water, while golf courses earn $5,000-$7,000 per acre-foot of water.” Because of the little water that marijuana requires, its growth in the desert can be justified.

Professor Dale Devitt of UNLV told the Las Vegas Review Journal that the relatively low water requirements of medical marijuana and the high retail price will place it ahead of the other crops in the area in terms of profitability per acre-foot of water.

With the lower amounts of water used (lower production costs), medical marijuana businesses have great hopes for high profits. Terra Tech, a publicly traded firm, has estimated that it will produce 75 pounds of marijuana each week. According to MMJ Business Daily’s report, that means a yield of $15 million to $25 million in annual sales.

With low water requirements and high estimated profits, speculators have already begun to line up. With proposals flooding in in Clark County, The Las Vegas Review Journal reported that the wide range of applicants include medical professionals, business people, and former politicians.

In addition, marijuana advocates are launching petition drives in hopes of placing the cannabis legalization bill on the 2016 ballot. According to MMJ Business Daily, those in favor of the industry making headway in Nevada foresee it becoming even larger than the current market in Colorado.

$9M in Startup Costs for Marijuana Dispensary

With the help of businessman Howard Kessler, owner of Financial Services Consulting Company from Boston, “New England Treatment Access” will open stores in Brookline and Northampton. A cultivation facility will open in Franklin this year with owners Kevin Fisher and Arnon Vered working very hard to keep all them going.

Ambition

Kevin and Arnon have received two of the 20 provisional dispensary licenses awarded by the State. Their ambitions are high and their projections show them jetting to nine point eight million dollars by 2015.

They assume each patient will pay $786.00 an ounce and with their projections of 1.6 ounces each month, it works out to $4800 for a pound. With the help of their medical marijuana account they will grow their revenues to $19 million dollars by 2017 and reach their peak patient count in 2016 with 3,200 people. (Don’t we all want $19 million by 2017?)

Their risk

Notably, they have jumped into a hostile business, not to mention it is just barely coming out of the stone ages of bureaucracy and banking issues to boot. They have market size issues to deal with, fluctuations in ill patients, insurance issues, and economy uncertainties.

Regardless, their prospectus is a winner. They have high value on their product and as low an overhead as they can manage. As long as they can see the consequences and prepare for them, they’ve got this in the bag.

Gone are most of the days when Chech and Chong hung around to fill their truck up with weed smoke. Now, a strong business has come to light and professionals are stepping up to coordinate nice institutions for people to purchase the marijuana wears. Doctors are prescribing the herb for pain and stomach issues as well as full clothing lines and other items.

Who knows where Kevin Fisher and Arnon Vered will be by 2017, but at least they are willing to make a try for a business that they can perceive as profitable and worthy. Unlike what it used to bring to mind in the 70’s and every church fearing mother would hide her children. Now it has come full circle and out of the dark and into the light. It’s nice to see fear being driven away from something that shouldn’t be scary.

Big Names Vying for Nevada Marijuana Payment Processing Business Licenses

Clark County had 206 proposals from over 100 groups for the medical marijuana businesses and they are targeting unincorporated areas of the county. Like any good business, these people can smell a profit without even leaving the comfort of their favorite chair. People that know people that have been in the business for years, can now complete their thoughts about a brighter future without looking over their shoulders for the local Constables.

Who’s who

On the top of the list is Sig Rogich. Once presidential adviser to Ronald Reagan, Sig currently operates a public relations firm in Nevada. Only eight years ago he managed a campaign that challenged the medical marijuana on a ballot initiative.

Next would be Chad Christensen, a former Las Vegas assemblyman that has teamed up with one of the local banking veterans, Daniel Brasov. Of course we also have Bill Feather. Bill is the former president of the Planet Hollywood Resort and he has partnered with Oscar Goodman. He is the son of Las Vegas’s previous Mayor.

Lobbyist and former legislator for Nevada is David Goldwater. With a partnership created with Greta Carter. Carter is the President of the Cannabis Training Institute in Seattle. That should make lots people nervous.

And we can’t forget

The wife of Larry Ruvo; Camille. Ruvo is a philanthropist and senior managing director for one of the largest distributors of alcoholic beverages on the Vegas strip. That should fit right into what Larry already has going. Of course, there is also Nick Spritos. He’s the director of the Women’s Cancer Center of Nevada. His partner is Geoffrey Hsieh an oncologist.

Should we be nervous?

Not yet at least. For the time being, these are people that have thought things over and know that they could definitely fit this new side business into their current one. It would be a good fit.

For right now though, Las Vegas and Reno have not accepted applications for medical marijuana businesses. They realize they will indeed attract those of an elite field, and for now, they will just sit on things.

For those servicing the new commodity in Colorado and Washington, things are beginning to work out for the better. A long time coming are some banking options that were not available a year ago.

Colorado speed bumps

In Colorado co-ops will be created that are to service accounts specific to the needs of the market with marijuana buyers and growers. Sellers might have a bit of an issue for a time, but all the other elements are falling into place. Marijuana Merchant accounts will be over seen by the state’s financial services commissioner.

Each co-op will do business very similar to that of a credit union, without the requirement of deposit insurance:  Thereby, leaving each new business owner without that extra FDIC insurance, through the federal government, in case the institution fails. Deposit insurance is that little extra kick all other consumers get when they deposit money, and it seems a bit out of the ordinary for Colorado to set up these new businesses, with the expectation of failure.

Washington as well

Washington has stepped up the bar a bit further. They are already using well established credit unions through Numerica Credit Union. They don’t want to offer accounts to the recreational stores but will work with the processors and the growers.

On the other hand, they won’t let them have more than five million dollars in any account.

-They won’t let them have debit or credit cards for their accounts.

-They won’t let them deposit any check remotely.

-All deposits must be done in person and they won’t let them deposit in the night deposit.

-Of the 17 branches that Numerica has, the person with the new medical marijuana account, must live in the area in order to even have an account.

And last, but not least……. They won’t let them make deposits or withdraw their own money from other credit unions that are part of the same credit union network.

Progress

Indeed, it is being made….. but at what expense? The person trying to run their new business will have to move to the right county and make any deposits in person. They can’t access their own money but in person and not from other atm machines. Indeed, progress. But is it really?

Pharmacies Await Legalization while Pot Firms Gain

Any ideas or dreams of profit and competition for CVS Caremark Corp., Walgreen Co., and Rite Aid Corp. will not be coming true anytime soon. Even though 21 states have legalized pot for medical use, the drug is still currently illegal under federal law. Because of this, banks are hesitant to accept any money from the sale of marijuana; thus, leaving the market to local entrepreneurs.

As long as marijuana is classified as a Schedule 1 drug, pharmacies will not be able to sell medical marijuana legally. According to an article by Bloomberg’s Shannon Pettypiece and Sonali Basak, “The drug is classified as a Schedule I controlled substance, defined as having a high potential for abuse with no accepted medical use.” The article goes on to say that “Schedule 1 drugs, which includes heroin, can’t by law be prescribed or dispensed.”

In order for pharmacies to be able to dispense controlled substances, it must be registered with the U.S. Drug Enforcement Agency. All three major pharmacies, Walgreen, CVS, and Rite Aid have announced separately that they have no intentions of selling medical marijuana, which would jeopardize their company’s registration with the DEA.

According to Bloomberg Industries analyst Brad Barker, “That may change if the U.S. Congress sees taxes on the drug as a way to raise money.” If more products were made that were approved by federal regulators, more pharmacies might be able to sell medical marijuana. For example, Marinol is an approved prescription pill made with synthetic cannabinoid for the purpose of treating nausea caused by chemotherapy.

As far as investing, three states do allow medical marijuana companies to make a profit from the sale of pot. Shareholders have already begun investing in publically traded marijuana companies. Others, such as large industries and the larger pharmaceutical companies are looking into it in order to be prepared for when legalization occurs.

According to Bloomberg, “Until legalization or more products are marketed by pharmaceutical companies, it will be an industry dominated by small dispensaries set up to serve about 1.4 million medical marijuana cardholders using the drug to treat their symptoms.”

For now, traditional pharmacies are forced to watch from the sidelines while entrepreneurs make considerable gains. Entrepreneur Khalatbari, in an interview with Bloomberg, says that “We’re making money, we’re employing people, we’re being a beacon of light for this industry and showing it can be done professionally. That to me is a success.” Khalatbari expects to make $2 million in sales this year.

The Cannabis Industry’s Struggle to Acquire Payment Services Continues

Things are still at a very difficult point for the marijuana industry due to conflict between state and federal laws. The state of Colorado was the first state to legalize (in 2012) the sale and use of small amounts of marijuana for recreational purposes. However, the battle with the payment industry and banks still continues. The fact still remains that marijuana is illegal under federal law.

According to Jim Daly’s article for Digital Transactions, “the federal Drug Enforcement Administration considers marijuana a so-called Schedule 1 drug, right up there with heroin, LSD, Ecstasy, and other hard drugs ‘with no currently accepted medical use and a high potential for abuse,’ according to the DEA Web site.”

The industry is now fighting to be able to obtain payment card merchant accounts for its businesses. The present cash-only nature of the industry not only makes it at risk to crime, but it is also very impractical and difficult for the business owners to deal with. Banks refuse to do work with business owners if they inform them upfront of the nature of their business. In addition, when a personal credit card was the only option, it has been known for banks to cancel the card after becoming suspicious about the owner’s transactions. With banks refusing to provide payment card merchant accounts and keeping a strict eye on the transactions of business owners in the industry, operating in cash is still the only option.

To put it in the words of Daly’s interviewee, Rod Hurlbut, “’It’s a nightmare,’ says the 58-year-old former accountant and real-estate developer. ‘It’s not a good thing. It’s absolutely a nightmare.’”

In an effort to try to compromise, Deputy Attorney General James M. Cole issued a memo on August 29th to federal prosecutors. This memo directs the prosecutors to refrain from enforcing the marijuana provisions of the CSA in the states where cannabis is legal. This refrainment will stand as long as the states conform to eight priorities which he then outlined.

According to Digital Transaction’s article, “They included preventing the distribution of pot to minors, preventing marijuana revenues from going to gangs and cartels, preventing the diversion of marijuana from states where it is legal to those where it is still banned, and other provisions.”

So far, there really have not been many changes for the cannabis industry. The early months of 2014 saw the ban by payment card networks in signing illegal merchants as card acceptors. Visa Inc., however, did issue a statement leaving the signing of new pot shops up to the discretion of its acquirers.

According to Digital Transactions, Visa Inc. made this statement in regards to its decision,  “In this instance, the federal government considers the sale of marijuana illegal, but has announced that it will not challenge state laws that legalize and regulate marijuana sales. Given the federal government’s position and recognizing this is an evolving legal matter with different standards applicable in different states, our local merchant acquirers are best suited to make any determination about potential illegality.”

For now, business owners will have to operate in the awkward position between state and federal law. Until a more practical solution can be found and they are able to obtain payment card processing services, they will have to deal with handling the overwhelming amounts of cash they receive in weekly sales. Regardless of the state laws, the CSA still prohibits banks-and everyone else-from dealing with controlled substances or any proceeds that come from them.

According to a statement made by the association’s president and chief executive, Don A. Childears, “I believe there is nothing the executive branch can do to change this. The resolution of this requires, literally, an act of Congress, which isn’t likely in the near future.”

Colorado Passes New Option of Co-p Banking for the State’s Marijuana Sellers

Colorado is leading the way in creating the nation’s first state-run financial cooperative designed for marijuana sellers. The goal of this legislation is to give marijuana sellers access to key banking services through the U.S. Federal Reserve. Concerns have risen over how the marijuana industry has been forced to operate mainly through cash. The cash-only nature of the industry makes it a large target of crime.

As of Wednesday May 7, the approval was given by both chambers of the General Assembly when they both cleared their own versions of the bill.  For now, the bill has been sent to Governor John Hickenlooper in hopes of obtaining his signature.

There are many reasons for passing this bill. In 2012, Colorado legalized the possession and use of cannabis by adults for recreational purposes. In January of 2014, the first recreational cannabis shops were opened in Colorado. The concern now is that the cash-only nature of the industry will make it difficult for the state to track revenues for tax-collection purposes. In addition to this, owners will have limited access to credit and capital. Further, there is the great risk of burglary due to operating in cash-only.

According to an article by Keith Coffman of Thomson Reuters, “Under the bill, the financial cooperatives would operate similarly to credit unions – without a deposit insurance requirement – and would be governed by the state’s financial services commissioner.”

One obstacle to overcome is the need for the Federal Reserve to approve this plan in order for the industry to have access to Marijuana credit card processing and checking accounts. Even though the Obama administration issued new law-enforcement guidelines in February to encourage banks to do business with marijuana suppliers, banks are still hesitant until changes are made to federal law.

According to Keith Coffman, “The guidance stopped short of promising blanket immunity to banks, and financial industry officials have said they doubted many banks would begin to accept cannabis suppliers as customers without changes in federal law.”

For now, the state of Colorado awaits the approval of several bills by the Governor. There is a bill intended to allocate tax revenues derived from retail pot sales to marijuana enforcement. It also includes a proposal to fund education programs that will urge youth to abstain from the use of drugs. Another bill headed to the Governor’s desk is the bill requesting a limitation on the amount of concentrates found inside cannabis products. With the approval of these bills by the Colorado legislature, the industry now awaits the Governor’s decision.

Who really hold the Cards on Rescheduling Marijuana?

imgresEric Holder the Attorney General has revealed that the Obama administration wants to work with Congress on rescheduling marijuana. Currently, cannabis is a schedule narcotic under the Controlled Substances Act- with LSD and heroin. Under schedule I you will find drugs that have a high potential for abuse and they have no medical value. Holder said during a House Appropriations Committee hearing,” We would be more than glad to work with Congress if there is a desire to look at and reexamine how the drug is scheduled”.

Currently, the Obama administration wants to work with Congress if, the lawmakers want to take marijuana off the list the federal government considers to be dangerous drugs.

There have been members of Congress that have called on the administration to down grade cannabis without waiting for congressional action.  But under the federal Controlled Substance Act, the authority to remove any drug or substance form the schedules the drug or substance must be found to not meet the requirements for inclusion in any schedule. Holder has not admitted if he is willing to do this unilaterally.

There, is no documentation of deaths due to over dosing on Marijuana, still the federal government treats marijuana as a Schedule I Drug with a “high potential “ for abuse sharing the spot light with Heroin, LSD, and Ecstasy.

By re-categorizing marijuana is not going to legalize the drug under the federal law, but it will make research into the medical benefits of marijuana much easier and allow the marijuana businesses to take tax deductions. Easing the restrictions on research, and rescheduling will allow tax deductions for the businesses of the cannabis industry. Even if marijuana is not legalized the rescheduling of marijuana will change the federal classification, allow it to be somewhat closer to being accepted and a part of reality.

Some Republican lawmakers question Holder’s decision granting Colorado and Washington the right to legalize and regulate marijuana and for taking the state’s actions into consideration when prioritizing marijuana prosecutions.

To-Date any move to reschedule marijuana is probably encountered with resistance from the Drug Enforcement Administration, which Holder “over sees”. Michele Leonhart Chief DEA believes with the growing acceptance of marijuana it will only make her agents fight that much harder against the problems that will be born to the legalization of marijuana. Even with DEA pressure the Obama Administration has decided not to interfere with recreational legalization laws in Colorado and Washington.

Many say that Congress needs to make this change, and the administration would be happy to work with Congress, but what they do not say is the “Attorney General” is the one who has the power to reschedule or remove a drug from the schedules without Congressional support. Even if it looks as though the administration is unwilling to reclassify marijuana without broad consensus.

The Concern with Marijuana Cultivators Water Use

Marijuana cultivators illegal and legal in Northern California are possibly draining all the water from a region that is shadowed in drought. The streams and rivers are already running dry and the cultivators are sucking what little water is left out of them.

California Department of Fish and Wildlife are finding streams that will probably dry up this year, and the agency feels it is more than likely the marijuana cultivators behind this serious problem.

“Essentially, marijuana will consume all the water that is left, every bit of it, “said State Fish and Wildlife Senior Environmental Scientist Scott Bauer, who specializes in salmon recovery who is currently working on a study of this problem. Hopefully these finding will be released soon, and we will know the real impact of this unregulated industry.

California has been on the radar for a while for polluting the streams and the forest with the use of pesticides and trash. California also has had a history of bulldozing trees and earth to make clearings for gardens.

A red flag goes up when the State Fish and Wildlife see a huge spike in water usage; this is usually an indication that there is a very big possibility that you will find a pot cultivation operation being run.

Over time this increase in water usage will add to the drought conditions, which in turn will add to the habitat degradation and kill off the restoration efforts that many have worked to replenish, and replace.

“The destruction of a habitat is actually quite staggering” said Patrick Foy, a spokesman with the State Department of Fish and Wildlife. “Last year, 24 North Coast salmon-bearing tributaries were reported to have gone dry, though not all were verified by the agency” said Bauer

Even if California was not having a problem with drought there still would not be enough water for the marijuana cultivators because the plants require a vast amount of water and the industry is growing rapidly.

Illegal marijuana was confiscated in California by law enforcement recently it totaled between $2-4 million dollars annually it was estimated that the cultivators used 1.8-billion gallons of water over a five-month growing season which was based on the average water usage documented in a study.

Satellite images, give researchers the information they need to determine that approximately 30,000 legal and illegal marijuana plants are growing all along the four major watersheds just in Mendocino County alone,  and there are probably tens of millions more in neighboring Humboldt and Lake counties.

Each plant consumes an average of six gallons of water a day, so the plants in question located in Mendocino County probably consume 180,000 gallons a day from each watershed, which is the size of a 160 foot Olympic-sized pool/spa.
